The website ginamavi.com is hosted by Shopify.

These Terms of Service apply to the use of our website and to purchases made through our online store. Our Privacy Policy, Shipping Policy and Return and Refund Policy also form part of the terms applicable to your purchase.

2. Products

Gina Mavi offers products featuring original watercolor artwork and designs. Most products are manufactured and fulfilled after an order is placed through print-on-demand production partners.

We make reasonable efforts to display product descriptions, dimensions, materials and colors accurately. However, colors and appearance may vary slightly depending on screen settings, production methods and the materials used.

Please review product descriptions and compatibility information carefully before ordering, particularly for phone cases, laptop sleeves and other device-specific products.

We may update or discontinue products before an order is placed. Changes will not affect orders already accepted.

3. Personalized Products

Some products may be personalized with a name, date, message, photograph or other content requested by the customer.

You are responsible for checking that all personalization details are complete and correct before placing the order. Production may begin shortly after an order is accepted, and changes may not be possible afterwards.

You confirm that you have the necessary rights and permissions to use any text, image, photograph, name or other material submitted for personalization. We may refuse content that is unlawful, offensive or infringes the rights of another person.

The statutory right of withdrawal may not apply to products made according to your individual specifications or clearly personalized for you. Products featuring our standard designs are not considered personalized solely because they are manufactured after an order is placed. 4. Orders and Contract Formation

The presentation of products in our online store is an invitation to place an order.

By clicking the final order button, you submit a binding offer to purchase the products in your cart. Before submitting the order, you can review and correct your order details.

After placing an order, you will receive an electronic order confirmation. The purchase contract is concluded when we accept your order by sending the order confirmation.

We may refuse or cancel an order before acceptance if, for example:

• The product is unavailable.

• Payment cannot be authorized.

• The delivery address cannot be served.

• The order information is incomplete or clearly incorrect.

• We reasonably suspect fraud or unlawful activity.

• Personalized content violates these Terms or the rights of another person.

If payment has already been collected for an order that we cannot accept, the amount will be refunded.

Please contact us as soon as possible if you wish to correct or cancel an order. We cannot guarantee that changes will be possible after production has started. Your statutory withdrawal rights remain unaffected.

5. Prices and Payment

Prices are displayed in the currency selected for the relevant market. The total price, available payment methods and applicable shipping charges are shown before you submit your order.

For deliveries outside the European Union, customs duties, import taxes or other local charges may be imposed by the destination country. Unless expressly stated otherwise during checkout, these charges are not included in the purchase price and are the customer’s responsibility.

Payments may be processed through Shopify Payments, PayPal or another payment method displayed at checkout. The terms and privacy policies of the selected payment provider may also apply.

We reserve the right to change prices and promotions for future orders. Price changes do not affect orders already accepted.

6. Production, Shipping and Delivery

Products may be manufactured and shipped by our print-on-demand production partners from facilities located in different countries.

Production and delivery times shown on the website are estimates. Delivery may be affected by production schedules, the destination, customs processing, public holidays, carrier delays or circumstances outside our reasonable control.

For consumer purchases, the risk of loss or damage remains with us until you, or a person designated by you other than the carrier, receives the goods. This does not apply if you independently appoint a carrier that was not offered by us.

7. Checking Your Delivery

Please inspect your order after delivery and contact us as soon as possible if it is damaged, defective, misprinted, incomplete or different from what you ordered.

Where possible, include your order number, a description of the issue and clear photographs. Do not return an item to a production partner unless we provide specific instructions.

Your statutory rights regarding defective goods remain unaffected.

8. Returns and Right of Withdrawal

Consumers may have a statutory right to withdraw from an online purchase within 14 days after receiving the goods.

Certain exceptions apply, particularly to goods made according to the customer’s individual specifications or clearly personalized products.

9. Statutory Guarantee

Consumers have statutory rights if goods are defective, do not correspond to their description or do not provide the characteristics that can reasonably be expected.

Nothing in these Terms limits or excludes mandatory consumer rights under Austrian law or the consumer-protection laws applicable in the customer’s country of residence.

10. Customer Accounts

You may be able to create a customer account to view orders and manage certain information.

You are responsible for keeping your login information confidential and for notifying us if you suspect unauthorized access. Information provided through your account must be accurate and current.

We may restrict or deactivate an account if it is used unlawfully, fraudulently or in violation of these Terms.

11. Intellectual Property

Unless otherwise stated, the artwork, designs, illustrations, photographs, videos, text, branding and other original content displayed on ginamavi.com belong to Georgia Mavi or are used with appropriate permission.

This content is protected by copyright and other intellectual-property laws. It may not be copied, reproduced, modified, distributed, sold or used commercially without prior written permission.

Purchasing a product does not transfer ownership of the artwork, design or intellectual-property rights displayed on that product.

The names and logos of Shopify, Printful and other third parties belong to their respective owners.

12. Reviews and Customer Content

If you submit a review, photograph or other content, you confirm that:

• The content reflects your genuine experience.

• You have the right to submit it.

• It does not violate another person’s intellectual-property, privacy or other rights.

• It is not unlawful, misleading, abusive or offensive.

You grant us a non-exclusive, royalty-free permission to display and reproduce the submitted content for operating and promoting our store. You retain ownership of your content.

We may decline or remove content that violates these Terms or applicable law.

13. Acceptable Use

You must not use the website:

• For unlawful or fraudulent purposes.

• To infringe intellectual-property, privacy or other rights.

• To introduce viruses, malicious code or harmful technology.

• To interfere with the website’s security or operation.

• To collect personal information about other users without authorization.

• To send spam or misleading communications.

Purchases made through ginamavi.com are contracts directly between you and Georgia Mavi, trading as Gina Mavi. Shopify is the provider of the e-commerce platform and is not the seller of our products.

15. Liability

We are liable in accordance with applicable law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for intentional misconduct, gross negligence, personal injury, mandatory product liability or the violation of mandatory consumer rights.

We are not responsible for disruptions or delays caused by events outside our reasonable control, but your mandatory statutory rights remain unaffected.

Personal information is processed according to our Privacy Policy and the cookie choices available through our website.

17. Changes to These Terms

We may update these Terms to reflect legal, technical or business changes. The current version and its last-updated date will be published on this page.

Changes do not apply retroactively to orders already concluded unless required by law or expressly agreed with the customer.

18. Governing Law

These Terms and purchases made through the store are governed by Austrian law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not remove mandatory protections granted by the law of the country in which they usually reside.

The legally applicable rules determine which courts have jurisdiction. Nothing in these Terms limits a consumer’s mandatory right to bring proceedings before a competent court.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be replaced by the applicable legal rule.
